Revelan que la DEA y el FBI permitieron que agentes facilitaran información a cárteles mexicanos

La Administración de Control de Drogas (DEA, por sus siglas en inglés), el Buró Federal de Investigaciones (FBI) y la Oficina del Inspector General del Departamento de Seguridad Nacional permitieron durante tres años que agentes estadounidenses facilitaran información sensible a cárteles mexicanos para supuestamente seguir el rastro criminal, revela una investigación de Milenio.

En los hechos estuvieron involucrados el agente activo de la DEA, Juan Constanzo, y un jubilado de la misma agencia llamado Manuel Recio. Ambos fueron arrestados en mayo de 2022 y enfrentan una acusación penal por una variedad de delitos, incluyendo soborno.

Recio estuvo en la DEA desde 1997 hasta 2018. De acuerdo con la investigación, a su retiro, fundó la empresa de consultoría Global Legal Consulting, para brindar servicios de investigación privada a abogados defensores penales y ayudar a estos a reclutar clientes; pero también ofrecía un ‘servicio VIP’, de la mano de Constanzo, quien estaba activo en la agencia de control de drogas.

Según señala un comunicado de prensa del Departamento de Justicia del año pasado, Constanzo extraía información de los sistemas de la DEA y se la proporcionaba a Recio, entre ellas acusaciones selladas, con lo que daban aviso a sus clientes sobre investigaciones abiertas en su contra, identidades de otros acusados e incluso la fecha en que serían arrestados.

La fuente que usaron fue el Sistema de Información de Narcóticos y Drogas Peligrosas (NADDIS, por sus siglas en inglés), una base de datos de la DEA que contiene información sobre personas que están, o han estado, bajo investigación de la agencia.

De acuerdo con el Departamento de Justicia de EE.UU., “Recio le pagó a Constanzo por esta información”. La institución logró identificar el entramado de este esquema de corrupción, que incluyó pagos a través de terceros y teléfonos especiales; los montos fueron desde los 2.500 hasta los 70.000 dólares.

Entonces, la DEA, el FBI y la Oficina del Inspector General del Departamento de Seguridad Nacional llevaron a cabo una investigación en contra de Constanzo y Recio. La intercepción de llamadas entre estos y los criminales reveló que entre sus ‘clientes VIP’ estaban narcotraficantes mexicanos que eran objetivos prioritarios para la agencia antidrogas.

Sin embargo, lo que la defensa de Constanzo ha puesto en duda es que, como parte de la operación, durante casi tres años se le habría permitido al exagente seguir con la extracción de información de la agencia, para presuntamente seguir el rastro criminal; aunque el Departamento de Justicia dijo el año pasado que las acciones entre Constanzo y Recio duraron entre noviembre de 2018 y noviembre de 2019.

La defensa

La defensa de Constanzo se ha centrado en buscar desacreditar la acusación contra su cliente y para ello han cuestionado que se le dejase continuar en activo y operando.

Se pone a prueba la credibilidad de que si el agente especial Constanzo estuvo cometiendo delitos federales; tres agencias de aplicación de la ley le permitieron permanecer en activo durante años”, dijeron los abogados Marc L. Mukasey, Torrey K. Young y Stephanie Guaba en marzo pasado.

Asimismo, señalaron que a Constanzo “se le permitió ser agente de la DEA completamente activo, trabajar con altos funcionarios del gobierno de EE.UU., desde el inicio de la autorización inicial de escuchas telefónicas a partir del primero de julio de 2019 hasta su entrega, el 20 de mayo del 2022”.

De acuerdo con el Departamento de Justicia, Constanzo y Recio están acusados de conspiración para cometer soborno, recibir o pagar un soborno, conspiración para cometer fraude electrónico y fraude electrónico.

‘Rápido y Furioso’

Este caso recuerda al fallido Operativo ‘Rápido y Furioso‘, que se llevó a cabo durante el Gobierno de Felipe Calderón (2006-2012).

Este operativo ilegal permitió a las autoridades de EE.UU. traficar miles de armas a México, con ‘chips’, supuestamente para después rastrearlas y localizar a los delincuentes que las usaban.

No obstante, esas armas “fueron utilizadas en diversos delitos de sangre en el país, desde al año de 2009 hasta fechas recientes”, denunció la Fiscalía General de la República de México en un comunicado publicado el año pasado.
